Terms of Service

These Terms of Service ("Terms") govern your access to and use of the GhostPreppr mobile applications and the website at ghostpreppr.com (collectively, the "Service"), operated by GhostPreppr ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. By using the Service, you represent that you meet this requirement and that the information you provide is accurate.

2. The Service: Marketplace, Not a Restaurant

GhostPreppr is a marketplace that connects users ("you") with independent home-based food vendors ("preppers") operating from licensed kitchens. GhostPreppr does not prepare food. Preppers are independent operators responsible for the preparation, packaging, and food safety of the meals they sell. We facilitate listings, ordering, and payment.

3. Your Account

• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity under your account.
• Notify us immediately at support@ghostpreppr.com of any unauthorized use.
• We may suspend or terminate accounts that violate these Terms or applicable law.

4. Orders and Payment

• Prices are set by individual preppers and shown in the app at the time of order.
• Payment is processed by our payment partner Stripe. We do not store full card numbers.
• By placing an order you authorize the charge to your selected payment method.
• Taxes, service fees, and any applicable platform fees will be itemized at checkout.

5. Pickup, Delivery & Cancellations

• Most orders are pickup-only at the prepper's licensed kitchen address.
• Pickup windows and instructions are provided in the app and order confirmation.
• Orders may be cancelled before the prepper begins preparation. Once preparation has started, cancellations are at the prepper's discretion.
• If you fail to pick up an order within the stated window, the order may be forfeited without refund.

6. Refunds

If a meal is materially defective (e.g., the wrong item, missing ingredients, food-safety concerns), contact support@ghostpreppr.com within 24 hours with your order number and a description. We will work with you and the prepper to resolve the issue, which may include a refund or credit.

7. Allergens, Dietary Information & Food Safety

Preppers provide allergen and dietary information to the best of their ability, but kitchens may process common allergens (gluten, nuts, dairy, eggs, soy, shellfish, etc.). If you have a severe allergy, do not rely solely on the app — contact the prepper directly to confirm. GhostPreppr is not liable for adverse reactions or undisclosed ingredients.

8. User Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Submit false, misleading, or fraudulent information.
• Harass, threaten, or abuse other users, preppers, or GhostPreppr staff.
• Attempt to access accounts or systems you are not authorized to access.
• Reverse-engineer, scrape, or interfere with the Service.

9. Promotions, Codes & Credits

Promotional codes and account credits are non-transferable, have no cash value, and may be subject to additional terms communicated at the time of issuance. We may revoke promotions for fraud or abuse.

10. Intellectual Property

The Service and its content (excluding user-submitted content) are owned by GhostPreppr and protected by copyright, trademark, and other laws. You receive a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. You retain ownership of content you submit (e.g., reviews, photos), and grant us a worldwide, royalty-free license to use it in connection with operating and promoting the Service.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GHOSTPREPPR AND ITS OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID GHOSTPREPPR IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $100.

13. Indemnification

You agree to indemnify and hold harmless GhostPreppr from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

14. Dispute Resolution & Arbitration

Any dispute arising from these Terms or the Service will be resolved by binding arbitration on an individual basis (no class actions) under the rules of the American Arbitration Association, conducted in San Diego, California, in English. You may opt out of arbitration within 30 days of accepting these Terms by emailing legal@ghostpreppr.com with your account email and the words "Arbitration Opt-Out".

15. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Subject to Section 14, exclusive jurisdiction is in the state and federal courts located in San Diego County, California.

16. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or for any other reason. Sections that by their nature should survive termination (including ownership, disclaimers, limitation of liability, indemnification, and arbitration) will survive.

17. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via in-app notification or email at least 7 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance.
